Cheeya Personal Data Policy


General Information About the Personal Data Protection Law

The Personal Data Protection Law No. 6698 (hereinafter referred to as "KVKK") was adopted on March 24, 2016, and published in the Official Gazette No. 29677 on April 7, 2016. Certain provisions of the KVKK came into effect on the date of publication, while others became effective on October 7, 2016.


Notification as the Data Controller

In accordance with KVKK No. 6698, your personal data will be processed within the framework described on this page by Cheeya, acting as the "Data Controller." Your data may be recorded, stored, updated, disclosed/transferred to third parties in cases permitted by law, classified, and processed in the manner specified by KVKK.


Processing of Your Personal Data

Under KVKK, personal data you share with us may be processed by Cheeya in whole or in part, automatically or manually, as part of any data recording system. Processing refers to any operation performed on personal data, such as collection, recording, storage, alteration, or reorganization, in accordance with KVKK.


Purposes and Legal Basis for Processing Your Personal Data

Your personal data will be processed to:

  • Fulfill the requirements of services provided to our customers and perform them in compliance with contractual and technological needs.
  • Identify transaction owners’ information (such as identity, address, and other necessary details) in accordance with relevant laws such as the Law on Regulation of Electronic Commerce No. 6563, the Consumer Protection Law No. 6502, the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce, and the Regulation on Distance Contracts.
  • Comply with mandatory obligations in banking and electronic payment systems, such as creating payment records or documents in electronic or paper formats.
  • Provide requested information to authorized public bodies, courts, and other legal authorities in matters related to public security or legal disputes.

Your personal data will be processed in compliance with KVKK and related secondary regulations.


Sharing Your Personal Data With Third Parties

For the purposes mentioned above, your personal data may be shared with:

  • Our e-commerce infrastructure provider, Ikas Teknoloji A.Ş.
  • Suppliers, delivery companies, and other parties involved in providing services.
  • Program partner organizations, domestic and international entities, and other third parties with whom we collaborate or engage for services.

Methods of Collecting Personal Data

Your personal data may be collected through:

  1. Online Forms: Information provided via forms on our website or mobile applications, such as name, surname, identification number, address, phone number, and email address.
  2. Transactional Data: Preferences and activities on pages accessed through username and password, including IP records, browser-generated cookie data, navigation details, and location information.
  3. Sales and Marketing Channels: Verbal, written, or electronic data shared through sales staff, paper forms, business cards, and other sales and marketing channels.
  4. Business Interactions: Information shared during business interactions, such as submitting CVs, proposals, or participating in events.
  5. Other Channels: Data obtained indirectly via websites, blogs, contests, surveys, games, campaigns, newsletters, and publicly available data sources.

Personal Data Collected Before KVKK

Personal data obtained lawfully before KVKK came into effect on April 7, 2016, such as membership, electronic communication permissions, or purchases, will also be processed and stored in compliance with this policy.


Transfer of Personal Data Abroad

Personal data collected in Turkey may be transferred abroad to accredited service providers in countries deemed to have adequate data protection safeguards, provided such transfers comply with KVKK and the purposes specified in this document.


Storage and Protection of Personal Data

Your personal data will be securely stored in our databases and systems as per Article 12 of KVKK. Except as required by legal obligations or stated in this document, your personal data will not be shared with third parties.
Cheeya takes the necessary precautions, such as access management and physical security measures, to prevent unauthorized access or unlawful processing. In the event of unauthorized access to personal data, the matter will be reported to the Personal Data Protection Board as required by legal regulations.


Keeping Personal Data Accurate and Up-to-Date

Cheeya is obligated under Article 4 of KVKK to ensure the accuracy and up-to-date status of personal data. To fulfill this obligation, our customers are responsible for providing accurate and current information or updating their data via our website or mobile applications.


Rights of the Data Subject Under KVKK

As per Article 11 of KVKK, which came into effect on October 7, 2016, data subjects have the right to:

  1. Learn whether their personal data is being processed.
  2. Request information regarding the processing of their data.
  3. Learn the purpose of data processing and whether their data is being used for its intended purpose.
  4. Know the third parties to whom their data is transferred domestically or internationally.
  5. Request correction of incomplete or inaccurate personal data.
  6. Request the deletion or destruction of personal data as per Article 7 of KVKK.
  7. Request notification of correction, deletion, or destruction to third parties to whom their data has been transferred.
  8. Object to adverse outcomes arising from the processing of their data solely through automated systems.
  9. Demand compensation for damages incurred due to unlawful processing of personal data.
